John Redlon stated that he was supposed to be at the last meeting but was waiting on his Planning Board documents to be processed.

  • Public Hearing of an amendment to the Maple Ridge Subdivision of Gray to allow work to begin with a performance bond for erosion control only.  Applicant is Sanborn Group, Gray, Maine.  Map 41, Lot 3.  Agent is Pinkham and Greer.

Terry Sanborn stated that he would like to begin work with a performance bond for erosion control.

George Thebarge stated that this is part of the new ordinance amendment.  The new subdivision ordinance contains a section that allows a conditional agreement.  This project is unusual as there is a water line extension off Route 100.  He suggests the Board look at the onsite improvements, and look at the Route 100 construction issue differently.  He recommends that the Board look at both the onsite and offsite work separately.  The Board would look to the engineer for cost estimate.

Richard Bibber asked when this project was approved.  George stated that it was in 2007.  Richard Bibber asked which ordinances are being observed.  George stated that the current ordinance is being observed with the exception of the performance guarantee.  All other items that were approved in 2007 remain and were approved under the old ordinance.

Richard Bibber asked what the advantage is for the performance guarantee for erosion as requested.  

Jason Wilson stated that it is a zero sum gain since, if the project cannot progress or economic factors change, the applicant is required to return the property as it was originally.

John Redlon asked about the Gray Water District’s requirement for a performance guarantee.  George suggests that the Board require a performance guarantee for the offsite water line.  Jason suggests including the Water District performance guarantee as one of the conditions of approval.

Dan Cobb asked for clarification on what will be done.

Terry Sanborn stated that it will be rough site work (roads, underground work etc.).  Dan Cobb asked when the lots will be for sale and what percentage of the site work etc will be done.  Terry Sanborn hopes to begin the sale in Spring of 2010 and estimates about 50% should be completed.

George stated that the Town can remove No buildings are to be sold and no building permits issued until the on-site public improvements are completed per the conditional agreement.~

Motion to approve amendment to the Maple Ridge Subdivision of Gray to allow work to begin with a performance bond for erosion control only.  Applicant is  Sanborn Group, Gray, Maine.  Map 41, Lot 3.  Agent is Pinkham and Greer.

Subject to standing conditions:
  • The project shall be constructed and maintained in accordance with the plans, textual submissions, and testimony presented to the Planning Board by the applicant and its representatives.
  • Subject to a conditional agreement per Section 401.11.1 C. for the on-site infrastructure improvements including the road, utilities, storm drainage and treatment. ~A financial performance guarantee meeting the requirements of Section 401.11.1 A or B shall be submitted for the erosion & sedimentation control plans and for all off-site improvements in an amount approved by the Town Engineer.~~ ~Said guarantee to be submitted and approved prior to the start of any construction.
  • No buildings are to be sold and no building permits issued until the on-site public improvements are completed per the conditional agreement.~ This restriction can be removed upon submission of a performance guarantee meeting Section 401.11.1 A or B to the Town by the developer for any remaining improvements that have not been completed.
  • The conditional agreement does not affect the developer’s responsibility to a post a performance guarantee for all off site improvements, including the water main on the Portland Road.
