Gray Planning Board Minutes
January 28, 2010 - 7:00 p.m.
UPSTAIRS – STIMSON HALL

At 7pm, Don Hutchings stated that there was no quorum at this time and they would wait 5 minutes to see if other Planning Board members would show up for the meeting to proceed.

Jason Wilson arrived at 7:03pm and there was a quorum for the meeting to proceed.

Jason Wilson moved; Dan Cobb seconded

Motion to accept the January 14, 2010 Planning Board minutes as written.

  • Tabled Matters and Unfinished Business
  • Request for minor subdivision approval for one additional lot at the corner of Route 115 and Mayall Road.  Applicant is KBMT c/o Michael Hotham, 27 Marshview Dr., New Gloucester, Me.  Applicant’s agent is John Palmiter.
George Thebarge stated the reasons why this item was tabled from the last meeting.  Lot C’s driveway needs to be on the Mayall Rd.   The applicant has put an easement to this effect and George has drafted conditions for approval for the Board.

Dan Cobb commented on the one driveway serving all lots as in a subdivision.  Don Hutchings stated that this is an existing lot.

George stated that in previous meetings that the Board wanted both driveways to be on the Mayall Rd.  Under the criteria for subdivision they have the legal authority to do so, but the Board wanted to offer a compromise since there is an existing driveway on Route 115.

Don stated that Lot B has no change.  George stated that MDOT has approved the driveway/entrance off Mayall Rd and that it would also me the street construction ordinance requirements.  

Michael Hotham stated that he has been given approval for the placement by Gorrill-Palmer.


Jason Wilson moved; Dan Cobb seconded

Motion to approve for one additional lot at the corner of Route 115 and Mayall Road.  Applicant is KBMT c/o Michael Hotham, 27 Marshview Dr., New Gloucester, Me.  Applicant’s agent is John Palmiter. Subject to standing conditions:

  • The project shall be constructed and maintained in accordance with the plans, textual submission, and testimony presented to the Planning Board by the applicant and its representatives.
  • The Board finds that the proposed 1-lot minor subdivision satisfies the subdivision criteria and performance standards.
  • The driveway for Lot C shall be on the Mayall Rd and the existing driveway serving Lot B shall be allowed to remain in place.
  • Prior to the issuance of a building permit, the applicant for Lot C shall provide sufficient documentation to address Item #4 in a letter from Gorrill-Palmer Associates dated 11/11/09 relating to potential flooding of the building site to the satisfaction of the Code Enforcement Officer.
  • The lot must be served by public water.

Dan Cobb reiterated the conversation from the November meeting about getting materials from applicants in a timely manner.  He would like to see a more formal process or motion on this issue.  He stated that it is difficult to properly review and assess proposals when things are not received in a timely manner.

Don suggested to George that he craft some wording for the Board to review.  He suggests that materials be submitted 72 hours prior to the meeting and that he can notify the Board that materials are available at Town Hall.
