Minutes

The Board of Appeals for the Town of Gray will meet on
July 22, 2009
at Stimson Hall at 7:00 p.m.
to act on the following variance requests, in accordance with the Town of Gray Zoning Ordinance as adopted and as amended to April 20, 2004.

Vincent Palange, Debbie Flanigan, Kathy Wood, Barry Watson, Kyle Coolidge
Code Enforcement Officer Ryan Keith, Doug Webster

Others present and speaking:  Jodi Chute, Craig Chute.


Approval of Minutes  

June 24, 2009 Minutes

Barry Watson moved; Vincent Palange seconded.

Motion to accept the June 24, 2009 Zoning Board of Appeals minutes as corrected.


Kathy Wood commented that on 1st paragraph that there is a typo.  It should read “to” and the phrase “he asked…” should be rewritten as “Bill Dale asked”… for clarity.

New Business

Election of Officers 2009 -2010 Term

Kyle Coolidge stated that he would like to nominate Kathy Wood as new chair.  He commended Barry Watson on his 5 years of excellent work as chair.  
He nominated Barry Watson as Vice Chair to continue his work with his experience and expertise on the committee.

Kyle Coolidge moved; Vincent Palange seconded.

Motion to make Kathy Wood Chair of the Gray Zoning Board of Appeals.

Motion to make Barry Watson Vice Chair of the Zoning Board of Appeals.

Jodi Chute,  P. O. Box  74, Casco, Maine 04015, property located at 11 Portland Road, Gray, Maine is requesting a variance to reduce the width of a Back lot access easement from sixty feet to thirty feet as required in Section 402.7.5.A.1 of the Gray Zoning Ordinance for the purposes of creating a back lot and constructing a single family dwelling.

Jodi and Craig Chute stated that they would like to create a back lot behind the existing lot, but require 60 feet of access.  Ryan Keith stated that since the applicant has applied and this request was publicized, there are a few options that have come up that may not require Zoning changes.  He presented copies to the Board.   Kyle Coolidge stated that since the options being presented do not require a variance, they don’t need to make a request for a variance.  Ryan Keith asked if there are issues from the Board on the options presented to be certain.

Doug Webster asked for clarity on option A and whether or not they have 40 feet and should there be any issues since they are present, it may be appropriate to address them at this time.
Kathy Wood stated that they have more than enough frontage to meet the criteria. Ryan Keith stated that he will continue to present these items to be certain to address any possibility that may arise in the future.
