Public Notice: Negotiated Exactions First Read

Notice is hereby given that the Gray Town Council will hold a first reading on April 18, 2017 at 7:00 p.m. at the Henry Pennell Municipal Complex, 24 Main Street, Gray, Maine, to receive public comments on proposed changes to both the Gray Zoning Ordinance (Chapter 402) and the Town’s Subdivision Ordinance (Chapter 401) that give the Planning Board the authority to require owner/applicant of a commercial and/or residential project to submit information and pay for all or part of improvements to off-site public infrastructure that is adversely affected by a development when warranted.

The anticipated effect(s) on publicly owned facilities, including roads, intersections, water supply, stormwater, etc., will be determined by the Planning Board on a development-specific basis. The proposed Ordinance language for these “Negotiated Exactions” includes a new Section 402.10.16 of the Zoning Ordinance and two new sections of the Subdivision Ordinance (401.6.1.H and 401.8.1M).
